Is it legal to sail in Spain with the Polish flag?

This is the most frequent doubt. The answer is **yes, it is completely legal**, as long as the following mandatory obligations in Spain for Spanish tax residents are met:

  • Payment of Spanish taxes: The boat must have VAT paid and have paid the Special Registration Tax (12% for lengths greater than 8 meters) in Spain. The change of flag does not exempt from local taxes if the shipowner resides in Spain.
  • Appropriate nautical qualification: The Spanish skipper who sails in Spanish waters must have the Spanish recreational title corresponding to the length of the boat (PNB, PER, Yacht Skipper or Yacht Captain), and cannot rely on unvalidated foreign licenses.
