Spanish self-employed taxes: forms 303, 130 and annual income tax

VAT, income tax instalments and the annual return serve different purposes. Separate the forms and prepare your business records before filing in Spain.

Form 303 concerns Spanish VAT, known as IVA; form 130 concerns advance payments of personal income tax, IRPF, under the direct assessment method; the annual return reviews income tax for the tax year. These forms are not interchangeable, and not every self-employed person files the same ones. Start by identifying your activity, applicable regime and registered tax obligations.

This guide suggests how to prepare information for discussion with your gestoría. It does not calculate an individual tax return: it helps distinguish concepts, locate documents and identify unanswered questions. The jurisdiction is Spain. Mention territories with specific tax arrangements, international transactions or multiple activities at the outset.

What to prepare for Spanish VAT form 303

VAT is an indirect tax on consumption transactions; distinguish VAT charged to customers from VAT on purchases that can be deducted subject to its conditions. Form 303 is a VAT self-assessment whose application depends on the relevant regime and reporting frequency. Preparing it is not a matter of copying your bank balance. Organise transactions and distinguish issued invoices, documented purchases and issues needing review. An unpaid invoice or a credit note should not disappear among bank movements. [1] [7]

Do not assume that all input VAT is deductible or that every activity works the same way. Flag expenses with both private and business use, incomplete invoices and transactions whose treatment is unclear. Provide those questions separately, with supporting documents, so they can be reviewed before the return is finalised, without turning a provisional classification into a tax decision.

  • Group issued invoices, received invoices and corrective invoices without replacing one with another.
  • Note transactions needing clarification and explain what is unclear.
  • Keep the document archive separate from the list of bank receipts and payments.

How form 130 works and why exceptions matter

IRPF taxes the income of the individual, including income from their activity; it is not another name for the VAT on invoices. Form 130 is used for advance income tax payments for activities under direct assessment. Keep earlier returns from the same tax year when preparing your enquiry: reviewing only invoices from the latest period can leave out relevant information. Organise a summary of income, expenses, withholding and amounts already declared, showing the source of each figure and who checked it. [2] [4]

Not every professional must make instalment payments: the Spanish income tax regulations provide exceptions linked to withholding. Having an invoice with tax withheld is not enough to draw a conclusion. If you are starting out, combining activities or changing your client base, prepare that information to check the applicable rule before filing or stopping a return. [3]

  • Gather earlier returns for the tax year and their filing receipts.
  • Identify withholding on your income and keep its supporting records.
  • Ask about your own obligation instead of copying another self-employed person.

How advance payments relate to the annual income tax return

Instalments and withholding are advance payments; the annual income tax calculation takes them into account under its rules. Keep a consistent history of the tax year instead of treating every filing as an isolated matter. The annual return also involves more than business activity alone: gather the personal and financial information that needs to be considered together. [4]

Create an annual index of returns, certificates and outstanding documents to make that review clearer. If a certificate, your records and a filed return disagree, identify the figures and their origins instead of changing files blindly. Preserve the previous version and explain what you found; this makes it easier to decide whether there is an error and how to address it.

  • Keep withholding certificates and proof of advance payments.
  • Gather information about other income and personal changes for review.
  • Identify differences between documents before accepting an annual summary.

A practical filing system for invoices and tax records

VAT records organise information about transactions and tax amounts. In practice, give each document an identifiable name and link it to its entry, avoiding folders full of files named only invoice or document. If an invoice is missing, flag it as outstanding and request the correct document: an organised list should also show what has not yet been checked. [5]

The records required for income tax depend on the activity and regime. The AEAT provides formats that can be used jointly for IVA and IRPF when they contain the necessary information. Before changing your spreadsheet or software, agree with the person reviewing the records which format to use and how to supply corrections, equipment purchases and documents received after a period has been prepared for closing. [6]

  • Organise by tax year and period, with separate folders for outstanding documents.
  • Link each entry to its invoice or evidence and avoid duplicates.
  • Keep a copy of the files delivered and a log of later changes.

The final review before and after filing

Before authorising a filing, ask for a clear summary: which form is being prepared, which period it covers, which documents are missing and which questions remain open. Check that your activities and any changes have been identified. A good handover is not about sending many files at the last minute; it allows another person to understand the information and find exceptions easily.

Afterwards, archive the filed return and its receipt with the reviewed documents. If an amount is payable, also check the payment status through the appropriate channel. Note any outstanding tasks and consult the current official calendar and instructions for future filings. Distinguish a saved draft, an enquiry sent to your gestoría and a confirmed filing.

  • Clearly distinguish a draft, reviewed document and return already filed.
  • Ask for an explanation of any unfamiliar figure before approving it.
  • Keep receipts and note which review needs to happen next.

Frequently asked questions

Does filing form 303 replace Spanish form 130?

No. They concern different taxes and purposes. Each filing obligation must be checked against your activity and regime. Filing one does not mean the other is covered or necessarily required.

Does withholding mean I do not have to file form 130?

You cannot decide this from one invoice. Exceptions depend on specific conditions. Gather income and withholding information, along with changes to your activity, to check whether you must make instalment payments.

What should I prepare first if my documents are disorganised?

Start by identifying the tax year and collecting invoices, records and earlier returns. List missing documents and specific questions. Provide an organised copy without deleting earlier versions or filling gaps with assumptions.
